Legislation required before EC restructuring: Bangladesh NAP

At present there is a lack of credible elections, democracy and good governance. The government must take the initiative to take the country forward by forming a fair election commission. Because they are in power. Bangladesh National Awami Party-Bangladesh NAP has demanded that there should be a specific law to set up an independent and impartial Election Commission (EC) for holding fair elections.

In a statement sent to the media on Sunday (September 19), party chairman Jebel Rahman Ghani and secretary general M. Golam Mostafa Bhuiyan made this demand.

They said the steps taken to form a search committee to make recommendations on the appointment of the Election Commission during the appointment of the current EC and its predecessors were nothing more than a ploy to evade the demand for enactment of the constitution. Because the President will approve the names of the government party and the Prime Minister who will propose in the search committee.

The leaders said it was as clear as daylight that the search committee would recommend the government’s nominees for the posts of chief election commissioner and other election commissioners. Because the constitution does not give any arbitrary power to the President to appoint to these posts. He is constitutionally bound to appoint the Chief Election Commissioner and the Election Commissioners on the advice of the Prime Minister.

They also said that since no law was enacted to appoint the EC as per the constitution, party governments have formed the EC with people who believe in their party ideology most of the time since independence to influence all elections, including national elections. Moreover, there is no precedent for that party to be defeated in a national election held under a ruling party.

The two leaders said that for the purpose of non-controversial, fair and election, it is necessary to formulate a constitution as directed by the constitution. All political parties should jointly demand the formation of an EC to enact laws directed by the constitution. The people want to believe that the ruling party Awami League will also come forward to enact the law. This will brighten the image of their team.
